1. Acceptance of Terms
These Terms and Conditions ("Terms") govern the use of the Care Esteem mobile application ("App"), provided by Care Esteem Ltd ("Company", "we", "us", or "our"). By accessing or using the App, you ("User") agree to be bound by these Terms. If you do not agree, do not use the App.
2. User Access and Eligibility
Access to the App is provided through a subscription managed and paid for by your organisation, agency, or employer ("Agency"). Your use of the App is authorised and controlled by your Agency administrator ("Admin"). If your Admin revokes access, your use of the App may be suspended or terminated.
You must be authorised by your Agency and of appropriate age to use this App.
3. Agency Subscription
- Agencies are responsible for managing user access and paying subscription fees.
- Users do not pay directly for App access.
- The Agency's agreement with us governs the billing and service terms.
4. User Accounts and Responsibilities
- Users must keep login credentials confidential.
- You are responsible for any activity under your account.
- You must not share your account or use anyone else's account.
5. Data Ownership and Privacy
- Your Agency may control or access data you create or upload in the App.
- Your use of the App is also subject to our Privacy Policy.
- We process your data in accordance with the agreement made with your Agency.
6. Acceptable Use
You agree not to:
- Violate any applicable laws or regulations.
- Upload harmful or unauthorised content.
- Attempt to gain unauthorised access to any system or data.
7. Intellectual Property
All intellectual property in the App (including but not limited to software, logos, and content) is owned by or licensed to Care Esteem Ltd. Use of the App grants no ownership rights to you.
8. Termination of Access
We or your Agency may terminate or suspend your access at any time, with or without notice, for any violation of these Terms or based on the Agency's discretion.
9. Disclaimers and Limitation of Liability
- The App is provided "as is" and "as available."
- We are not liable for any indirect, incidental, or consequential damages.
- Our total liability is limited to the amount paid by your Agency in the previous 12 months.
10. Modifications
We may modify these Terms at any time. Updates will be posted in the App or on our website. Continued use after such changes constitutes your acceptance.
11. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
